Embattled former Cabinet Secretary Raphael Tuju has announced that he moved into Dari Business Park as of Sunday morning. According to the ex-CS, he will reside at the premises in accordance with a court ruling barring the sale of the contentious property until a further ruling is made.

"THAT pending the hearing and determination of this application, there shall be an order preserving the substratum of the dispute, and accordingly, there shall be no sale, transfer, assignment, alienation, charge, lease, disposal, or in any manner whatsoever dealing with the title and/or ownership of the suit property (L.R. No. 11320/3 and L.R. No. 1055/165) until further orders of the Court," a court ruling cited by Tuju reads in part.  

Tuju noted that he will remain at the property, asserting that he does not need security officials, who he claims are working under the dictates of his adversaries.

 

"After all, they illegally raided my premises, they assaulted me, and they or their masters can not be my friends. If these are the type of people who claim to be my friends, I would rather be with my enemies," he said in a statement on Sunday.

"The police should only be on site to enforce Court orders not to be part of a land grab operation. According to the latest Court rulings this is my property. The police can not come to evict me without a valid court order. If they produce such a court order, I will obey."

 

The property has been at the centre of a long court battle over the auction Tuju's prime properties in Karen.

The dispute involved the alleged failure to repay a Ksh.1.9 billion loan borrowed from the East African Development Bank (EADB) in 2015. The initial borrowed amount was USD 9,197,084 (Ksh.1.2 billion) and the rest accrued in interest.

 

Other properties include Entim Sidai Wellness Sanctuary of LR No.11320/3, Off Tree Lane, Karen, and Tamarind Karen.

On March 19, Tuju wrote to Inspector General Douglas Kanja protesting what he describes as an unlawful police occupation of Dari Business Park.

In a letter, Tuju claimed that more than 100 police officers raided the premises in the early hours of March 13 without a court order and have remained stationed there for nearly a week.

He later went missing and resurfaced claiming that he was being trailed and had sought refuge at a home in Kiambu. The Directorate of Criminal Investigations (DCI) said that he had staged the disappearance, and forensic investigations showed that he was hiding in his home.

 

He was taken into custody for the offence of providing false information. He was later released on a personal bond of Ksh.100,000 and directed that witness statements and exhibits be supplied to the defence. Citizen Digital
