Court has issued a warrant for the arrest and extradition of a nurse working and living in the United States of America to face contempt of court charges after his ex-wife accused him of disregarding orders to support his three-year-old daughter's needs. 

The warrant was issued by Eldoret Senior Principal Magistrate Cheronoh Kesse in a case where Noah Kibet Mutai is involved in a bitter child support dispute with his former wife Nancy Jemutai Samoei.

Kesse directed the Officer Commanding Station (OCS) at the Jomo Kenyatta International Airport (JKIA) to arrest the accused person upon his arrival before delivering him to her court to be punished for disobeying the court order. 

 In the orders issued on July 17, 2024, the Court had directed that the US-based nurse pay Kshs. 20,000 per month to his ex-wife to meet the minor’s financial needs and other related expenses. 

Mutai, however, disregarded the court order and left the mother of his child to shoulder the burden of supporting the minor’s needs alone.

Nancy has since left her matrimonial home and relocated back to her parents’ home in the Kapseret area after her former husband flew to the US, where he secured a nursing job without informing her. 

According to Nancy, she had been married to Mutai since December 2020, during which they were blessed with one child, code-named A.M who was born on August 16, 2023.

She added that despite being aware of his parental responsibilities, the respondent has totally ignored and refused to cater for the financial needs of the minor and other related expenses as ordered by the court. 

Attempts by the accused person to disown the minor by claiming that she was not his child were unsuccessful after a DNA test that was sanctioned by the court in 2024  revealed that he was the biological father of the baby girl.

But the defendant has since rejected the results, which he alleged were doctored, and filed an application for a neutral court-sanctioned and supervised DNA test to ascertain the truth on the paternity of the minor.

This was after he jetted back into the country with a view to resolving their marital differences, which collapsed, forcing him to fly back to the US.

The court will make further directions upon delivery of the defendant in court. Citizen Digital
